Mr Ergo offers this website, including all information, tools, products and services available through it, subject to your acceptance of these Terms of Service.

By visiting our website, creating an account, placing an order or purchasing a product from us, you agree to be bound by these Terms of Service and any policies referred to in them, including our:

Material changes to a product will not be made after an order is placed without informing the customer where reasonably practicable.

Nothing in this section limits any right or remedy available under Australian Consumer Law where a product is materially different from its description, sample or demonstration model.

  1. Ergonomic and Health Information

References to “ergonomic”, “lumbar support”, “posture support”, “comfort”, “pressure relief” and similar terms describe the intended design and features of the product.

Individual comfort and suitability vary depending on factors such as:

The customer’s height and weight
Body proportions
Existing furniture and desk height
Chair adjustment
Sitting position
Duration and pattern of use
Personal comfort preferences
Existing injuries or medical conditions

Mr Ergo products are not medical devices and are not intended to diagnose, treat, cure or prevent any medical condition.

Information provided on our website is general product information and is not medical, occupational health, physiotherapy or ergonomic advice.

Customers with an existing injury, disability, medical condition or specific workplace requirement should obtain advice from an appropriately qualified professional before purchasing or using a product.

Nothing in this section limits any consumer guarantee, express representation or other right that cannot legally be excluded.

Customers are responsible for reviewing the product information and deciding whether a product is suitable for their intended use.

An automated order confirmation confirms that we have received the order. It does not necessarily mean that the order has been accepted or dispatched.

We may decline or cancel an order on reasonable grounds, including where:

There is an obvious pricing or description error
Payment cannot be authorised
Fraud or unauthorised payment is suspected
The delivery address is incomplete or outside our service area
The order breaches a purchase limit

Where we cancel an order after payment has been received, we will refund the amount paid for the cancelled product to the original payment method.

We cannot guarantee that an order can be changed after it has been submitted to our supplier, warehouse or fulfilment provider.

  1. Prices and GST

Unless otherwise stated:

Prices displayed on mrergo.shop are in Australian dollars
Prices include GST where GST is applicable
Delivery charges are calculated or displayed during checkout
Any available discount must be applied before checkout is completed

Prices may change without notice. A price change will not affect an order that has already been accepted, except where there has been an obvious pricing error.

  1. Pricing and Website Errors

We may correct errors or omissions relating to product information, promotions, availability, shipping charges or pricing.

Where an obvious error affects an order, we may contact the customer and offer the choice of:

Proceeding with the corrected information or price; or
Cancelling the affected product for a full refund.

We will not charge an additional amount without the customer’s agreement.

  1. Discounts and Promotions

Discount codes and promotional offers:

Must be used within their stated validity period
May be limited to selected products or customers
May not be combined unless expressly stated
May be subject to minimum purchase requirements
Cannot be exchanged for cash
Cannot generally be applied after an order has been completed

We may withdraw or correct a promotion where there is a genuine error, misuse or technical problem. This does not affect an order already accepted unless the customer agrees or the promotional price was clearly an obvious error.

  1. Payment

Payment must be made using one of the payment methods offered at checkout.

By submitting payment information, you confirm that:

You are authorised to use the payment method
The information supplied is accurate
There are sufficient funds or credit available
The transaction is not fraudulent or unlawful

Payments may be processed by third-party payment providers. Their separate terms and privacy practices may also apply.

Mr Ergo does not store complete payment card information where payment is handled by an external payment provider.

  1. Fraud Prevention

We may carry out reasonable verification or fraud-prevention checks before accepting or dispatching an order.

We may request additional information where reasonably necessary to verify:

The identity of the purchaser
The authority to use the selected payment method
The billing or delivery address
A high-value or unusual transaction

An order may be delayed or cancelled if the requested verification cannot be completed.

  1. Availability

Products are subject to availability.

Occasionally, a product may become unavailable after an order has been placed due to inventory errors, supplier shortages, discontinued products or other circumstances.

Where this occurs, we may:

Offer a reasonable alternative
Offer to place the product on backorder
Offer a revised estimated dispatch date
Cancel the unavailable product and issue a refund

We will not substitute a materially different product without the customer’s agreement.

  1. Shipping and Delivery

Orders are delivered in accordance with our Shipping Policy.

Delivery dates and timeframes are estimates unless we expressly agree to a guaranteed delivery service.

Delivery may be affected by:

Carrier delays
Supplier delays
Customs or import processing
Severe weather
Natural disasters
Industrial action
Transport interruptions
Peak sales periods
Incorrect customer information
Events outside our reasonable control

We will take reasonable steps to keep customers informed of material delays.

Nothing in this section removes any right a customer may have where an order is not supplied within an agreed or reasonable time.

  1. Delivery Address

Customers must provide a complete and accessible delivery address.

Customers are responsible for additional costs reasonably incurred because:

An incorrect or incomplete address was supplied
The carrier could not safely access the premises
The customer failed to collect the shipment
The customer was unavailable where attendance was required
Redelivery was required due to circumstances within the customer’s control

These costs will not apply where the delivery failure was caused by Mr Ergo, our supplier or our delivery provider.

  1. Authority to Leave

Where the customer or carrier selects an authority-to-leave option, the order may be left in a location considered reasonably safe by the carrier.

Customers should consider the risk of theft, weather exposure or damage before authorising unattended delivery.

Nothing in this section excludes responsibility that cannot legally be excluded or removes any obligation to ensure that the product is properly delivered.

  1. Inspection After Delivery

Customers should inspect the product and packaging as soon as reasonably practicable after delivery.

If a product arrives damaged, incomplete or incorrect, contact sales@mrergo.shop and provide:

Your full name
Your order number
A description of the issue
Photographs or video of the product
Photographs of the packaging
A photograph of the shipping label, where relevant

Customers should retain the packaging until they have confirmed that the product is complete and undamaged.

A failure to inspect the product immediately does not remove any right available under Australian Consumer Law.

  1. Assembly

Some Mr Ergo products require assembly.

Customers must:

Read and follow the supplied assembly instructions
Use the supplied components and hardware
Ensure all components are properly tightened
Stop assembly if a component appears damaged, missing or incorrect
Avoid using excessive force during assembly
Contact Mr Ergo if assistance is required

Damage caused solely by incorrect assembly, unauthorised modification or failure to follow the supplied instructions may not be considered a manufacturing defect.

This does not apply where unclear instructions, a defective component or another issue for which Mr Ergo is responsible caused or contributed to the damage.

  1. Product Use and Maintenance

Products must be used:

For their advertised purpose
Within their advertised weight capacity
On an appropriate and reasonably level surface
In accordance with the supplied instructions
With reasonable care and maintenance

Customers should periodically inspect and tighten accessible screws, bolts and fittings where recommended.

Products must not be altered, modified or repaired using incompatible components.

  1. Returns and Refunds

Change-of-mind returns, return approval requirements, return shipping, inspections, refunds and cancellations are governed by our Return & Refund Policy.

Our Return & Refund Policy forms part of these Terms of Service.

Nothing in that policy or these Terms of Service excludes, restricts or modifies any right or remedy available under Australian Consumer Law.

  1. Australian Consumer Law

Our products come with consumer guarantees that cannot be excluded under Australian Consumer Law.

Consumer guarantees are separate from, and may continue beyond, any voluntary or written warranty offered by Mr Ergo.

Depending on the circumstances, customers may be entitled to a repair, replacement, refund, compensation or another remedy where a product:

Is not of acceptable quality
Is not reasonably durable
Does not match its description
Is not fit for a disclosed purpose
Does not meet an express representation
Is unsafe
Has a major or minor failure

Nothing in these Terms of Service attempts to exclude, restrict or modify a consumer guarantee or another right that cannot legally be excluded.

  1. Five-Year Limited Warranty

Eligible Mr Ergo office chairs are supplied with a 5-Year Limited Warranty beginning on the original delivery date.

The voluntary warranty consists of:

Years 1 and 2: Limited Product Warranty
Years 3 to 5: Limited Structural Frame Warranty

The additional Years 3 to 5 coverage is limited to manufacturing defects affecting the chair’s primary fixed load-bearing structural frame.

It does not provide comprehensive coverage of every component for five years.

Detailed coverage, exclusions, eligibility requirements, claim procedures and expense arrangements are contained in the Mr Ergo 5-Year Limited Warranty Policy.

The 5-Year Limited Warranty Policy forms part of these Terms of Service.

The voluntary warranty is provided in addition to Australian Consumer Law rights. It does not replace or limit those rights.

  1. Warranty Claims

Warranty claims must be submitted to sales@mrergo.shop with:

The customer’s name
The order number or proof of purchase
The chair model
A clear description of the issue
Photographs or videos showing the issue
A photograph showing the complete chair
Any other information reasonably required to assess the claim

Customers may be required to complete reasonable troubleshooting steps before a claim is assessed.

Products and components must not be returned without prior approval.

  1. Replacement Components

Where a component is replaced, it may differ slightly in:

Colour
Texture
Finish
Shape
Branding
Minor design details

because of product updates or component availability.

Any replacement component will be reasonably compatible with the product and perform the same or a substantially similar function.

A replacement component or product does not restart the original warranty period. It remains covered for the balance of the original applicable warranty period, subject to Australian Consumer Law.

  1. Commercial Use

Unless otherwise stated on the applicable product page, Mr Ergo chairs are designed for normal home-office or single-shift office use.

The voluntary 5-Year Limited Warranty may exclude damage arising from:

Continuous multi-shift use
Rental or hire use
Public waiting-room use
Industrial use
Warehouse or workshop use
Use by multiple rotating operators beyond ordinary office use
Use outside the product’s advertised purpose

These voluntary warranty exclusions do not remove rights that apply under Australian Consumer Law.

All website content, including:

Text
Product names
Logos
Graphics
Photography
Videos
Page layouts
Product descriptions
Downloadable materials
Website code and design

is owned by, licensed to or used with permission by Mr Ergo.

Content may not be copied, reproduced, distributed, modified or commercially exploited without prior written permission, except where permitted by law.

  1. Reviews and User-Submitted Content

Where customers submit reviews, photographs, videos, comments or other content, they confirm that:

The content is truthful and based on their genuine experience
They have the right to provide the content
The content does not infringe another person’s rights
The content is not unlawful, defamatory, threatening or misleading
The content does not contain malicious code or confidential information

Customers grant Mr Ergo a non-exclusive, royalty-free licence to display, reproduce and use submitted content for operating and promoting the business.

We may moderate or remove content where we reasonably believe it is unlawful, misleading, fraudulent, offensive, irrelevant or in breach of these Terms.

We will not prevent or remove a review solely because it is negative.

  1. Third-Party Services and Links

Third-party services are governed by their own terms and privacy policies.

Liability for personal injury caused by negligence where it cannot legally be excluded

To the extent permitted by law, Mr Ergo is not responsible for indirect or consequential loss that was not reasonably foreseeable and was not caused by our breach, negligence or unlawful conduct.

Any limitation in these Terms applies only to the maximum extent permitted by law.

  1. Customer Responsibility

A customer may be responsible for loss or damage directly caused by their:

Unlawful use of the website
Fraudulent conduct
Material breach of these Terms
Infringement of another person’s intellectual property rights
Unauthorised modification or misuse of a product

A customer will not be responsible for loss caused or contributed to by Mr Ergo, our suppliers, service providers or a product defect.

  1. Events Outside Reasonable Control

Neither party will be responsible for delay caused solely by an event outside their reasonable control, provided they take reasonable steps to minimise the effects of the delay.

This may include severe weather, natural disasters, transport interruptions, government restrictions, industrial action or major system outages.

This section does not allow Mr Ergo to retain payment indefinitely without supplying the ordered product and does not limit any right relating to unreasonable delay or non-delivery.

  1. Changes to These Terms

We may update these Terms of Service from time to time.

Updated Terms will apply from the date they are published on the website.

Changes will not retrospectively remove rights or materially alter an order already accepted unless:

The customer agrees
The change is required by law
The change is necessary to correct an obvious error and does not unfairly disadvantage the customer

The date at the beginning of the Terms will show when they were last updated.

  1. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be read down or removed to the minimum extent necessary.

The remaining provisions will continue to operate.

  1. No Waiver

A failure or delay by either party to exercise a right does not automatically waive that right.

  1. Entire Agreement

These Terms of Service and the policies incorporated into them form the agreement between Mr Ergo and the customer relating to use of the website and purchases made through it.

They do not override any representation, consumer guarantee or legal right that cannot be excluded.

  1. Governing Law

These Terms of Service are governed by the laws applying in Queensland, Australia.

The parties submit to the courts and tribunals with jurisdiction in Queensland, subject to any right a consumer may have to bring a claim in another jurisdiction under applicable law.
